Terms of Sale

By placing an order for goods and/or services through our website, you, our customer, agree to the following terms and conditions as a legally binding contract: Immediately after placing ANY order, please email us at: [email protected] and provide the following information:

  1. The customer is responsible for confirming the accuracy of all information in the order before submitting same to us and also carefully reviewing our sales confirmation and/or invoice for correctness. Your order on our website is an offer to buy our products and our prices are quotations and not offers to sale. We reserve the right to accept or not accept any order. We reserve the right to reject any order for any reason in our discretion including inadequate inventory, change in pricing, your failure to promptly pay all amounts owed and provide all information needed to complete the order, incorrect shipping costs provided by any carrier, and/or breach of these Sales Terms and Conditions. All applicable sales, use, and other taxes will be charged to you on the order.
  2. Customer agrees to inspect the product when delivered by the carrier and, if any damage in the product or shipping materials is visible, the customer should write "accepted but damaged" on the driver's proof of delivery (bill of lading) and you should either receive a copy of the proof of delivery or take a photograph of same, after signing, with a camera (such as on your telephone). All claims for damage (including scratches, breaks, and cracks) to or shortages of product must be communicated to us within three (3) days of the date of delivery of the product and should be emailed to us at [email protected] and should contain both photographs of any damage, a copy of the signed delivery receipt and the following details:
    1. Number of damaged or missing products.
    2. Date of delivery
    3. Your Order number
    4. Your email and telephone number
    5. Confirmed address at which replacement product may be sent.
    In the case of damage or shortages, we will, at our discretion, either a delivery replacement product at our expense or provide you a credit on your credit card for the sales price of the damaged or missing product. Damage of up to eight percent (8%) of any shipment is considered normal in the industry.
  3. After three (3) days or installation of our products, whichever occurs first, our sale of product to you is final and we will be unable to accept any damage or shortage complaints or return and refund as to any products purchased. We reserve the right to modify or cancel any order prior to delivery (in which case you will need to agree to the modification or your purchase price will be refunded, with a refund also to be provided if we cancel the order).
  4. Customer is responsible for their delivery address and designation of an authorized agent to sign for the delivery on their behalf if the customer is not at the delivery address. All deliveries will be made curbside unless you make other arrangements with the shipping company. We cannot guarantee delivery by any particular deadline but will act diligently to meet your time requirements. If we are able to rush your delivery, we reserve the right to charge a reasonable amount for such expedited shipment and delivery. We reserve the right to ship your order in more than one shipment. We will send a tracking number to your email address and it is your responsibility to track the shipment so you can be present to receive the delivery. If the carrier hauling the products is not able to deliver to your designated location because of reasons other than the carrier's own fault, you may be liable for additional shipping and/or warehousing charges to store and/or re-deliver the products to you.
  5. All sales are final and may not be cancelled after the order is placed and is delivered; cancellations after the order is submitted but prior to delivery will be subject to liquidated damages equal to twenty-five percent (25%) of purchase price plus the cost for shipping the product back to us. Any refund, return, or exchange on any sale of our products that is not handled in accordance with our Sales Terms and Conditions and our Helpful Tips shall be at our sole discretion. If allowed, returns on a cancellation or exchange shall be at the customer's shipping cost and subject to both a twenty-five percent (25%) restocking charge. Product must be returned in original packing materials.
  6. To the greatest extent allowed by applicable law, all our Products are sold "as is" with all warranties, such as express warranties and implied warranties of merchantability, non-infringement, and fitness for a specific purpose, are hereby disclaimed by us and waived by you. We are not responsible for any consequential or special damages (even if we are notified by you of any special loss you will incur if the product is unsuitable for any reason) or punitive damages, and your right to recover compensatory damages shall be limited to the total sales price of the order.
  7. All orders are accepted in Florida. Florida substantive law, excluding the state's choice of laws, shall apply and govern use of this website, all orders for Product from us, and any relationship or dealings between you and us whatsoever.
  8. In the unfortunate situation of a dispute between you and us regarding any order, and we agree to the following process: (a) any dispute will be resolved exclusively in the state courts in Miami-Dade County, Florida and in no other venue or forum and by placing an order with us or using our website, you consent to personal jurisdiction the foregoing exclusive venue; (b) all rights to trial by jury are hereby waived and the parties shall submit their dispute to a judge only for final resolution; (c) any unpaid balances or other charges owed by customer shall bear interest at eighteen percent (18%) per year until paid; (d) the prevailing party shall be entitled to recover all costs, including reasonable attorneys' fees, incurred in any dispute arising out of, related to, or connected with our products or the sale to you, including all costs and fees incurred on appeal and in any bankruptcy or insolvency proceeding; and (e) any claim not filed by you within one (1) year of delivery of our products shall be time barred and waived.
  9. You agree we may communicate with you by email without sending a hard copy via mail or other method. You agree to regularly monitor your email for our messages, check your spam folder(s) for our messages, note the tracking information we provide in our email so you can timely receive your delivery, and to timely reply to our inquiries. For purposes of ordering products or addressing any other issue other than claims, you may communicate to us by the following email: [email protected].
  10. These Sales Terms and Conditions are a legally binding contract and our entire agreement and contract. No course of dealings or trade usages shall be a part of or modify our agreement. No verbal or other representation, promises, or discussions between you and us (including any of our representatives and agents) may vary, contradict, or supplement these Sales Terms and Conditions, which agreement may only be waived, terminated, modified, or amended by a further, separate writing signed by us. Any failure by us to enforce any term or condition shall not constitute a waiver without an express, signed document from us.
